A BILL to amend article twelve, chapter sixty-two of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
eleven-a, relating to eliminating parole.
Be it enacted by the Legislature of West Virginia:
That article twelve, chapter sixty-two of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eleven-a, to read as follows:
ARTICLE 12. PROBATION AND PAROLE.
§62-12-11a. Elimination of parole.
Notwithstanding any code provision to the contrary, the opportunity to be eligible for or to qualify for parole shall
cease no later than the thirty-first day of December, one
thousand nine hundred ninety-five. All boards, commissions,
appointees, and employees of the state or any political
subdivisions shall no longer exist within the meaning heretofore
provided in this code. Present parolees shall be transferred to
the probation mechanisms provided for in this code. Additionally
there shall be no indeterminate sentences after the thirty-first
day of December, one thousand nine hundred ninety-five.
NOTE: The purpose of this bill is to eliminate parole and
indeterminate sentences.
